|1. Terms of Payment
Payments are to be made in US Dollars.
Payment in full is expected at the time of product shipment unless other terms or arrangements have been agreed upon by NEMICON. We offer PayPal as a payment method.
In any case, order cancellation is not allowed.
|3. Shipping Charges
NEMICON’s product prices and shipping charges do not include duties and taxes which are imposed to buyers by custom office of the importing nation.
Shipping costs will be applied per every shipment. Any charges for customs clearance, import duties and taxes are payable by the recipient.
|4. Shipping Method
NEMICON offers UPS courier named “UPS Express Saver” only.
Ship date of “Quick delivery product (7S, 38SG, 38HG)”(Not delivery to you) is 5 business days after we confirm your order.
Ship date of “Normal product”(Not delivery to you) is usually 8 weeks after we confirm your order, but it takes 12 weeks for NE and OPN series
Shipping or delivery dates are not guaranteed, but are based upon best information available at the time and are subject to change without notice.
NEMICON CORPORATION will not be held responsible for any costs, damages or fees relating to parts arriving earlier or later than quoted. All duties & taxes (Export Duty & Taxs, Import Duty & Taxes, Insurance, etc) are the customers’ responsibility. NEMICON CORPORATION does not ship via the JAPAN Post Service.
|5. Return Policy
An RMA(Return Material Authorization) number is required to return any encoder to Nemicon. RMA numbers are issued by only Nemicon sales group and must be clearly marked on the outside of the returned parts package. Shipping charges must be prepaid for any returned parts. International RMAs must state that the product is returned to the “Country of Origin” on all return paper work in order to avoid additional customs fee. MRA number shall be provided if there is valid reason for the return from point of view of Nemicon sales group.
When warranty period terminate , reparing is charged to customer according to NEMICON’s regulations. If it is necessary to return encoders for repair, please contact Nemicon sales group(firstname.lastname@example.org) to obtain an RMA number. Along with the RMA, the return must include a valid purchase order number, return billing and shipping instructions, as well as a contact name of the sender , telephone number and e-mail address as well as photos of the phenomenon. Please include a brief description of your application and malfunction mode information regarding the problem with the product. All shipping charges (Export Duty & Taxs, Import Duty & Taxes, Insurance, etc) on returned products must be prepaid. When repair is charged, we will send the senders of the return a proforma invoice for repair charge. Nemicon can refuse free repairing on within warranty period encoder if there is no valid reason from Nemicon sales group standpoint.
(1) Our products provide a warranty of two years period after shipment.
(2) In this period, this warranty is not available if in following cases;
(a) The products are dropped, shocked, mishandled, or are used beyond the specifications determineded for products specification or catalogue.
(b) The natural disasters such as flood, fire, etc.
(c) The products are repaired or modified by others except NEMICON CORP.
|8. Inspection and Acceptance
Products shall be deemed finally inspected and accepted within 10days after receipt unless notice of claim is given in writing to NEMICON within such 10 day period.
In no case shall Nemicon be liable for indirect, punitive, incidental, consequential, or special damages to include but not limited to damages for loss of business, loss of revenue, loss of profit, loss of use or loss of other economic advantage, however caused and regardless of theory of liability, even if Nemicon has been advised of the possibility of such damages. Nemicon’s liability for damages shall in no event exceed (under any legal or other theory of recovery) the sum paid to Nemicon for the product causing the damages. Further, Customer agrees that its sole remedy for damages shall be limited, at Nemicon’s sole discretion to repair, replacement, or purchase price refund only after the product is returned in accordance with return policies.
Nemicon shall not be held responsible for delay if caused by or arising directly or indirectly from fires, floods, earthquakes, substantial damage to its plant, accidents, riots, open hostilities, declarations of national emergencies, war, government interferences or embargos, strikes, labor difficulties, shortage of labor, fuel, power, materials, or supplies or any other cause or causes beyond its control.
Confidential customer information is not provided to other without the consent of the customer.
|12. Law governing
The Terms and Conditions of Sale shall be governed by and construed under the laws of Japan, excluding its conflict of law provisions.
